2 CFR 200.311(c)(1) Disposition Instructions for the Public Housing Agency (PHA) Retention of Certain Public Housing Real Property (that is no longer used or was never used for public housing dwelling purposes) Free from Public Housing Use Restrictions - 2 CFR 200.311(c)(1) provides that when real property acquired or improved under a Federal award is no longer needed for the originally authorized purpose, non-Federal entities (e.g., PHAs) must obtain “disposition instructions” from the Federal awarding agency (e.g., HUD) that provide for the retention of title after compensating the Federal awarding agency. |

Guidance on Full Flexibility for Eligible Small PHAs - This notice provides guidance on the “full flexibility” of Capital Funds (capital funds) and Operating Funds (operating funds) for public housing agencies (“PHAs”) which own or operate less than 250 public housing units (“small PHAs”) and meet other requirements. The full flexibility articulated in this notice allows eligible small PHAs to undertake larger project improvements with capital or operating funds while promoting local discretion in prioritizing capital and operational needs. |

Guidance on the Public Housing Agency (PHA) salary restriction in HUD’s annual appropriations - This notice both supersedes PIH 2012-14, “Guidance on Public Housing salary restrictions in HUD’s Federal Fiscal Year (FFY) 2012 Appropriations Act (P.L. 112-55)” (issued February 24, 2012) and provides guidance to Public Housing Agencies (PHAs) regarding the provision in HUD’s annual appropriations that limits the use of Section 8 Tenant-Based Rental Assistance and Section 9 Public Housing Assistance funds to pay salaries (including any bonuses) to PHA employees, including chief executive officers, other officials, and any other employees. |
