Service of Process on HUD

Service of civil process on HUD, a HUD officer or employee sued in an official capacity, or the United States in an action involving HUD, must comply with all applicable rules, including the Federal Rules of Civil Procedure. Nothing herein modifies or waives HUD’s rights under those rules.

  1. For judicial proceedings involving a property in which HUD or the Federal Housing Administration (“FHA”) has an interest (including, but not limited to, single-family foreclosures, sheriff’s sales, bankruptcy actions, actions in probate, property maintenance, condemnation, easements, eminent domain, quiet title actions), serve process upon the Regional Counsel at HUD’s Regional Office where the property is located.  
     
  2. For judicial proceedings involving subpoenas for HUD employees or HUD records (e.g., Subpoena Duces Tecum, Trial/Deposition Subpoena) serve process upon the Regional Counsel at HUD’s Regional Office where the employee is located.
