Freedom of Information Act (FOIA)

The Freedom of Information Act (FOIA), 5 U.S.C. Sec. 552, enacted in 1966, requires federal agencies to provide documents after receiving a written request for them. An agency can withhold certain records from disclosure under nine different exemptions.

Many HUD documents are already available on this website, so we hope you'll check the Frequently Requested Materials and E-FOIA Reading Room first before submitting a written request. It is also helpful to search the hud.gov website.

If you don't find what you're looking for online, please submit a FOIA request to us. The easiest way is to submit a request online through the Making a FOIA Request. If you prefer to submit a FOIA request another way, please note that all FOIA requests must be in writing. No telephone requests will be accepted. Please be as specific as possible as to what documents you want. If you don't know the exact title of the documents, please provide a reasonable description of the documents to shorten processing time. Please mail or fax your FOIA request to:

Your FOIA request will be logged in as received and assigned a tracking number. Please refer to that number if you need to reach the FOIA Office for any reason.

 

This is an index of frequently requested materials.

 

There are a several things you should know about making a FOIA request.

First, if the document you want is located in a particular field office, please submit your request directly to the appropriate FOIA Requester Service Center.

Second, you must be fairly specific in what you request. Remember, FOIA only provides documents. It doesn't answer questions.

Third, you must agree to pay fees for various costs related to providing the requested records.

Can't find what you're looking for? Then Submit a FOIA request or send an email to FOIA@hud.gov. Remember, by submitting a FOIA request you are agreeing to pay the necessary fees. Be sure to fill out the form including your daytime telephone number, mailing address and email address.

HUD processes requests using multi-track processing, which allows the Department to process requests on a first-in/first-out basis, within each track.

HUD may expedite your request or appeal if we determine that you have a compelling need for the records or in other cases as determined by the Department. If HUD grants your request for expedited processing, HUD will give your request or appeal priority and will process it as soon as practical.

You may submit an appeal of HUD’s response to your FOIA request via email to HUDFOIAappeals@hud.gov or in writing (by mail, facsimile, messenger, or delivery service). The HUD response will provide instructions and a specific address to submit a written FOIA appeal of the decision.

If you submit your appeal via mail, your FOIA appeal must be postmarked within 90 calendar days of the date of HUD response to your FOIA request.

If you submit your appeal via email or other means (ie, facsimile, messenger, or delivery service), it must be received in the appropriate office by the close of business on the 90th calendar day after the date of HUD’s response to your FOIA request.

When submitting an appeal of a denial of your request for information, your appeal must contain the following information:

(1) A copy of your original request;

(2) A copy of the written denial of your request; and

(3) Your statement of the facts and legal arguments supporting disclosure.

When submitting an appeal for a denial of a fee waiver, the appeal must contain the following information:

(1) The address of the office that made the fee determination from which you are appealing;

(2) The fee that office charged;

(3) The fee, if any, you believe should have been charged;

(4) The reason(s) you believe that your fee should be lower than the fee charged or should have been waived; and

(5) A copy of the initial fee determination and copies of any correspondence concerning the fee.

When submitting an appeal for a denial of expedited processing, the appeal must contain the following information:

(1) A copy of your original request;

(2) A copy of the written denial of your request; and

(3) Your statement of the facts and legal arguments supporting expedited processing.

HUD will decide your appeal of a denial of expedited processing within 10 business days after its receipt. For any other type of appeal, HUD will decide your appeal within 20 business days after its receipt. HUD may have an additional 10 business days to make a decision if unusual circumstances require.

The Office of Government Information Services (OGIS) is a Freedom of Information Act (FOIA) resource for the public and the government. OGIS was established under the OPEN Government Act of 2007, codified at 5 U.S.C. 552(h). the Office of Government Information Services (OGIS), reviews Freedom of Information Act (FOIA) activities government-wide and helps to resolve FOIA disputes between Federal agencies and requesters.
