The Consolidated Appropriations Act, 2022 (P.L. 117-103) (the FY2022 Act) made available $1,516,409,207 for 1,014 congressionally-directed Economic Development Initiative-Community Project Funding (CPF) grants. The Consolidated Appropriations Act, 2023, (P.L. 117-328) (the FY2023 Act), enacted on December 29, 2022, included specific changes for CPF Fiscal Year 2022 grants.
Below is a brief overview of the changes and process updates from the FY2023 Act for CPF Fiscal Year 2024 grant recipients. HUD revised the initial published “FY2022 Community Project Funding Grant Guide” to align to these changes. The “FY 2022 Community Project Funding Grant Guide" provides detailed information on the changes, requirements, and process. If you have also been designated to receive an FY2023 CPF grant, HUD provided a separate correspondence regarding that grant and has provided additional detail on the FY2023 EDI-CPF section of the program website here.
HUD has offered and will continue to offer webinars to support FY2022 CPF grantees along with other technical assistance. The FY2023 Act includes the following changes for FY2022 CPF grants:
- The FY2023 Act clarifies that eligible expenses include administrative, planning, operations and maintenance costs;
- The FY2023 Act authorizes the grant funds to be used for reimbursement of otherwise eligible expenses incurred on or after the date of enactment of the FY2022 Act, and prior to the date of grant execution; and
- The FY2023 Act removes the previously applicable condition that expenditures for planning and management development and administration must not exceed 20 percent of the grant amount.
Additionally, HUD has determined that all of its FY2022 CPF grants are covered by one of HUD’s waivers of the Build America, Buy America (BABA) provisions, which means that BABA will not be applied to your FY2022 CPF grant.

Please work with your Grant Officer, System Officer, and Environmental Review Officer to complete the required steps. To account for the policy changes and clarify the applicable requirements for your grant due to the FY23 Act, HUD recommends that Grantees that received a fully executed grant agreement from HUD work with to HUD to amend and restate their FY2022 CPF Grant Agreement using the FY2022 CPF Amended and Restated Grant Agreement. If you have not already amended and restated your fully executed grant agreement received before February 28, 2023, and need assistance please reach out to your Grant Officer and/or Systems Officer.
